Man charged with lewd behavior in a bar
“It doesn’t appear to be an intentional act”
A man in his 50s who exposed his private parts while unzipping his pants in a bar has been acquitted.
Judge Hong Jun-seo of the Incheon District Court’s Criminal Division 5 announced on the 13th that he had acquitted Mr. A (50), who was charged with public indecency.
Mr. A was sent to trial on charges of committing indecent acts, such as walking about 20 meters in a bar in Incheon’s Michuhol District while exposing his private parts on March 27 last year at around 7 PM.
The prosecution charged Mr. A with a fine for causing sexual embarrassment to other customers, and the court also issued a summary order for him to pay a fine of 5 million won (about US$3,800).
Mr. A requested a formal trial, stating, “I did not intend to commit indecent acts except for not zipping up my pants after using the restroom while intoxicated.”
The surveillance camera footage taken at the incident scene showed that when bar employee Mr. B informed Mr. A about his unzipped pants, Mr. A turned around and zipped them up in surprise.
The judge explained, “Based on the surveillance camera footage, it does not appear that the person intentionally exposed their genitals,” and “Afterwards, Mr. A sat down and drank alcohol, and a dispute arose between him and Mr. B regarding the issue of clearing the drinks.” Therefore, the judge acquitted Mr. A, stating that no evidence supported Mr. B’s demand for punishment for public indecency.
