Woman Who Falsely Accused Lover-Boss Receives Jail Time

A woman in her 20s who had an affair with her boss at work was sentenced to prison after submitting a false complaint.

On the 12th, Judge Jeong Eun-young of the Seoul Eastern District Court announced that a woman in her 20s, Ms. Kwak, who was charged with innocence, was sentenced to 4 months in prison.

Previously, Ms. Kwak was handed over to the trial on charges of writing and submitting a false complaint regarding her boss, Mr. A, on August 30, 2021.

The complaint submitted by Ms. Kwak at that time contained contents such as “Mr. A abused his position as my boss and called me to the emergency staircase and habitually sexually harassed me” and “I couldn’t bear this situation and even thought about suicide, so please punish Mr. A.”

However, it was revealed that Ms. Kwak had been in a relationship with Mr. A, her boss and a married man, since around the summer of 2019. It also turned out that there was no incident of harassment from Mr. A.

In particular, Ms. Kwak was sued for damages by Mr. A’s spouse, who found out about her affair with Mr. A around November 2020. In April of the following year, a ruling was made that Ms. Kwak had to pay 18 million won to Mr. A’s spouse, and it was later found that Mr. A did not keep his promise to provide compensation for damages on behalf of Ms. Kwak.

During the trial, Ms. Kwak’s side argued, “It is not innocence because being sexually harassed is true,” but it was not accepted. The judge considered text messages between Ms. Kwak and Mr. A and a vehicle black box video showing their natural physical contact and concluded that Ms. Kwak falsely accused Mr. A despite being in an actual relationship with him.

Furthermore, the judge stated the reason for the prison sentence: “Innocent crime obstructs the function of the state’s criminal justice system, inflicts significant pain on the innocent party, and exposes the innocent party to the risk of unjust punishment. Therefore, severe punishment is necessary.”
