My older brother sexually assaulted my younger sister for 5 years.. What is the current situation and punishment?

A man in his twenties has been sentenced to prison for sexually assaulting his younger sister, who was a primary school student, over several years.

On the 16th, the Daegu District Court’s Andong Branch Criminal Division, presided over by Judge Lee Seung-woon, sentenced Mr. A (22), who was charged with violating the Special Act on the Punishment of Sexual Violence Crimes (rape, etc. against minors under 13), to 12 years in prison, the legal community revealed on the 17th.

In addition to the prison sentence, the court also ordered 40 hours of sex offender treatment programs and a seven-year employment restriction at child and youth-related institutions and facilities for the disabled.

The incident occurred in mid-2018. Mr. A was tried on charges of sexually assaulting his younger sister, Miss B, who was a primary school student at the time, and continued to do so for five years.

During the police investigation, it was revealed that Mr. A threatened Miss B by saying, “It will be X if you tell our parents,” and “I will X you if you don’t listen.”

Miss B informed her parents that she had been sexually assaulted, but received no help. The incident was reported to the police after a primary school counselor learned about the crime during a consultation with Miss B.

Currently, Miss B is living in a shelter in Gyeongbuk after being forcibly separated from her family and is known to be demanding severe punishment for Mr. A.

The court explained the reason for the sentence by stating, “The defendant committed a serious crime by repeatedly assaulting his sister over several years. The victim was harmed by a family member in her own home, which should be the safest place for her. The fact that the defendant has not been forgiven by the victim, and that the victim has actually experienced a miscarriage and even considered extreme choices, indicates that her pain is unimaginable.”

Previously, the prosecution had requested a 15-year prison sentence during the final trial, stating that “the defendant has continuously committed heinous crimes that defy humanity for five years, and the nature of the crime is bad.”

Meanwhile, if a person over 19 has sexual intercourse or commits indecent acts against a person under 16, or if a person under 19 does the same to a person under 13, it falls under ‘rape or indecent act against a minor’ and is punished.
