Man in 40s Attacks Inmate Who Declined Sexual Proposition

Commits another crime shortly after serving an 8-month prison sentence

An unbelievable incident has occurred in a prison.

A man in his 40s assaulted a young male inmate after being rejected for soliciting sex. He has been finally sentenced to prison.

According to Yonhap News and other sources, on the 26th, Judge Lim Jin-su of the Incheon District Court, Criminal Division 11, sentenced Mr. A (49) to 10 months in prison. He was indicted on assault charges.

Previously, Mr. A was indicted for punching inmate B (25) in the face several times and kicking him in the body in the Incheon Detention Center.

Assault on Inmate B and the Subsequent Hospitalization

At the time, it was reported that inmate B, who was assaulted, was hospitalized for three weeks. Also, Mr. A asked B, “Have you ever had sex with a man? Do you want to try with me?” However, he got beat up when B pressed the emergency bell in the detention room to report to the correctional officer.

Investigation revealed that Mr. A had committed another crime while being detained in Incheon Prison. This was only eight months after being sentenced to prison for assault in 2021.

Legal Consequences for Assault and Grievous Bodily Harm

In response, the court provided reasons for the sentence. They indicated that the defendant had a history of being punished multiple times for violent crimes. Also noted that the nature of the crime was not favorable, especially when considering the circumstances of the crime. Additionally, the court mentioned that the victim had not forgiven the defendant, and the defendant’s age was considered during the sentencing decision.

Meanwhile, if convicted of assault, under the current law, one can be sentenced to imprisonment for up to seven years, a fine of up to 10 million won (approx. US$8,400), or disqualification for up to 10 years.

In addition, if convicted of grievous bodily harm, one can be imprisoned for up to 10 years without a fine.
