Wife’s Affair Exposed After Vasectomy: Husband Fights for Custody and Assets

After the birth of their daughter, a man who had previously undergone a vasectomy discovered a condom in his wife’s bag—and now, he’s facing divorce.

YTN Radio’s show Consultation Room with Lawyer Jo In Seop shared the story of a man struggling to accept his wife’s claims after she allegedly cheated on him. Following their daughter’s birth four years ago, the man had a vasectomy, which made finding a condom in his wife’s handbag a devastating moment of betrayal.

Rather than confront her immediately, he gathered evidence of her infidelity before filing for divorce. While he’s pursuing damages from both his wife and her partner, his wife is demanding custody of their daughter and their jointly-owned apartment.

The man explained that they both had similar incomes and purchased two apartments together—one in each of their names and another in his name alone.

“I can’t bring myself to give her the apartment we bought together. And I definitely don’t want my daughter raised by someone who cheated and broke our family,” he said, seeking legal advice on how to protect his assets and secure custody of his daughter.

In response, lawyer Seo Jeong Min clarified, “Infidelity doesn’t automatically disqualify someone from being a fit parent. For the father to gain custody, he would need to prove he was the primary caregiver, that the daughter wishes to live with him, or that the mother has been violent toward the child.”

When it comes to dividing their assets, the lawyer added, “The court looks at each spouse’s overall contribution, not just individual ownership. Since it appears that the wife contributed to the purchase and upkeep of the apartments, they’ll be subject to division. However, if the man’s parents helped purchase one of the properties, gathering evidence of that financial support could allow him to claim it as his separate property.”
