Apple’s motion to temporarily pause a ban on imports of the Apple Watch in the U.S. amid a patent dispute over a blood oxygen measurement feature with American medical technology company Masimo has been denied by the federal appeals court. As a result, Apple is banned from selling its latest Apple Watches in the US.
According to CNN on the 17th (local time), the U.S. Federal Circuit Court of Appeals decided to reinstate the import ban on the Apple Watch, which had been suspended during the appeal process. The import of the Apple Watch Series 9 and Ultra 2 will be banned starting at 5 PM on the 18th.
In October last year, the U.S. International Trade Commission (ITC) banned the importation of the Apple Watch, which includes a blood oxygen measurement feature, into the U.S., claiming that Apple had infringed Masimo’s patent. As a result, Apple had to halt the sale of the Apple Watch ahead of Christmas last year.
Afterward, Apple appealed to the court, asking to “suspend the ITC’s import ban order while the appeal process is ongoing.” The court accepted this request, and Apple resumed selling the Apple Watch at the end of last year.
Meanwhile, Apple received import approval from the U.S. Customs and Border Protection (CBP) on the 12th to continue importing a redesigned version of the Apple watches. The redesigned watches will not contain a ‘pulse oxygen measurement’ feature.
